Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Disturv application (“Disturv”, the “App”) and the website at rektification.com (the “Site”), provided by Rektification (“we”, “us”, “our”). By installing or using the App, you (“you”, the “merchant”) agree to these Terms. If you do not agree, do not use the App.

1. The service

Disturv is a Shopify application that links Shopify products to Telegram channels. When a customer purchases a linked product, the App issues one-time Telegram invite links, approves join requests, and manages access duration, expiry, and renewals on your behalf.

2. Eligibility and accounts

You must have a valid Shopify store and the authority to bind your business to these Terms. You are responsible for maintaining the security of your Shopify account and for all activity that occurs under your use of the App.

3. Your responsibilities

• You must own or control the Telegram channels and the Telegram bot you connect to the App, and you are responsible for keeping the bot token confidential.
• You must comply with the Telegram Terms of Service and the Shopify Terms of Service at all times.
• You are responsible for the accuracy of your product and channel configuration, including access durations and pricing.
• You are responsible for your own communications with your customers and for the lawfulness of the content and communities you operate.
• You must not use the App for any unlawful, infringing, deceptive, or abusive purpose.

4. Fees and billing

The App is offered on subscription plans billed monthly through Shopify’s billing system. Current plans are based on the number of active members you manage:

• Starter — $4.99/month, up to 100 active members
• Growth — $9.99/month, up to 500 active members
• Pro — $24.99/month, up to 2,000 active members
• Business — $49.99/month, up to 10,000 active members
• Unlimited — $99.99/month, unlimited active members

New merchants receive a 14-day free trial. Charges are processed by Shopify and appear on your Shopify invoice. You authorise these recurring charges when you approve a plan. We may change plans or pricing on prospective notice; changes do not affect the current paid period. Billing disputes and refunds are handled in accordance with Shopify’s policies.

5. Third-party services

The App depends on third-party platforms, including Shopify and Telegram. We do not control those services and are not responsible for their availability, changes, rate limits, suspensions, or policies. Interruptions or changes to those services may affect the App’s functionality.

6. No affiliation

Disturv is an independent product. It is not affiliated with, endorsed by, or sponsored by Telegram or Shopify. “Telegram” is a trademark of Telegram FZ-LLC; “Shopify” is a trademark of Shopify Inc. These names are used only to describe interoperability.

7. Intellectual property

We and our licensors retain all rights, title, and interest in the App, the Site, and their content. We grant you a limited, non-exclusive, non-transferable right to use the App in accordance with these Terms. You retain all rights to your own data and content.

8. Disclaimers

THE APP AND SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or secure, and we do not guarantee the availability, performance, or continued operation of Telegram, Shopify, or any channel.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER FINANCIAL LOSS, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE APP IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses arising from your use of the App, your content or communities, or your violation of these Terms or any third-party rights or laws.

11. Termination

You may stop using the App at any time by uninstalling it from your Shopify store. We may suspend or terminate access if you breach these Terms or use the App in a manner that risks harm to others or to the service. On termination, your data is handled as described in our Privacy Policy.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above. Your continued use of the App after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles, and any disputes will be subject to the exclusive jurisdiction of the courts located there, except where prohibited by applicable law.
